5 July 2010 (*)

(Partial removal from the register)

In Case F‑103/09,

ACTION under Articles 236 EC and 152 EA,

John Allen, residing in Oxford (United Kingdom) and 111 other applicants whose names appear in the annex, represented by P. Lasok QC, I. Hutton and B. Lask, Barristers,

applicants,

v

European Commission, represented by J. Currall and D. Martin, acting as Agents,

defendant,

THE PRESIDENT OF THE FIRST CHAMBER OF THE TRIBUNAL

makes the following

Order

1        By letter of 21 June 2010 (the original being lodged on 25 June 2010) Mr Mick Bennett informed the Tribunal, in accordance with Article 74 of the Rules of Procedure, that he wished to discontinue his action.

2        By letter of 29 June 2010, the Commission indicated to the Tribunal that it had no observations to make on the discontinuance.

3        It is thus necessary to remove the name of Mr Mick Bennett from the list of applicants in Case F‑103/09.

4        Under Article 89(5) of the Rules of Procedure, a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance.

5        Since the Commission in its observations has not applied for an order for costs against the applicant, it must be concluded that each party shall bear its own costs.

On those grounds,

THE PRESIDENT OF THE FIRST CHAMBER OF THE TRIBUNAL

hereby orders:

1.      The name of Mick Bennett is removed from the list of applicants in Case F‑103/09.

2.      Each party shall bear its own costs.
