Application:      under Article 270 TFEU, applicable to the EAEC Treaty pursuant to Article 106a thereof, in which Mr Marcuccio seeks, in essence, compensation for the damage which he claims to have sustained as a result of the excessive duration of the administrative procedure concerning the claim he made to European Commission on 25 November 2002 for 100% reimbursement of his medical expenses under Article 72 of the Staff Regulations of Officials of the European Union (‘the Staff Regulations’).

Held:      The action is dismissed as being in part manifestly inadmissible and in part manifestly lacking any foundation in law. Mr Marcuccio is to bear his own costs and is ordered to pay the costs incurred by the European Commission.
