makes the following
Order
1 On 28 September 2007 Mr Daskalakis lodged an application at the Tribunal Registry.
2 By letter received at the Tribunal Registry on 8 October 2007, the applicant informed the Tribunal, in accordance with Article 99 of the Rules of Procedure of the Court of First Instance of the European Communities applicable mutatis mutandis to the Tribunal by virtue of Article 3(4) of Council Decision 2004/752/EC, Euratom of 2 November 2004 establishing the European Union Civil Service Tribunal (OJ 2004 L 333, p. 7) until the entry into force of the Rules of Procedure of the Civil Service Tribunal, that he was withdrawing his application. The applicant did not seek any order as to costs.
3 Consequently, in accordance with Article 99 of the Rules of Procedure of the Court of First Instance, this case is to be removed from the Register of the Civil Service Tribunal.
4 In accordance with the third subparagraph of Article 87(5) of the Rules of Procedure of the Court of First Instance, if a party discontinues or withdraws from proceedings and if costs have not been applied for, each party is to bear its own costs. In this case, since the proceedings were discontinued before the application was notified to the defendant and before the latter incurred any costs, it suffices to hold that the applicant is to bear his own costs.
On those grounds,
THE PRESIDENT OF THE TRIBUNAL
hereby orders:
1. Case F‑96/07 Daskalakis v Commission is removed from the Register of the Civil Service Tribunal.
2. The applicant shall bear his own costs.
