ORDER OF THE PRESIDENT OF THE FOURTH CHAMBER OF THE COURT

17 January 2020 (*)

(Removal from the Register)

In Case C‑114/18,

REQUEST for a preliminary ruling under Article 267 TFEU from the Court of Appeal (England and Wales) (Civil Division) (United Kingdom), made by decision of 31 January 2018, received at the Court on 14 February 2018, in the proceedings

Sandoz Ltd,

Hexal AG

v

G.D. Searle LLC,

Janssen Sciences Ireland,

THE PRESIDENT OF THE FOURTH CHAMBER OF THE COURT

after hearing the Advocate General, G. Hogan,

makes the following

Order

1        By order of 11 December 2019, received at the Court Registry on 20 December 2019, the Court of Appeal (England & Wales) (Civil Division), informed the Court that it wished to withdraw its request for a preliminary ruling.

2        In those circumstances, it is appropriate, pursuant to Article 100 of the Rules of Procedure of the Court of Justice, to order that the case be removed from the Register of Court.

3        Since these proceedings are, for the parties to the main proceedings, a step in the action pending before the national court, the decision on costs is a matter for that court. Costs incurred in submitting observations to the Court, other than the costs of those parties, are not recoverable.

On those grounds, the President of the Fourth Chamber of the Court hereby orders:

Case C114/18 is removed from the Register of the Court.

Luxembourg, 17 January 2020.
