ORDER OF THE PRESIDENT OF THE FIRST CHAMBER OF THE CIVIL SERVICE TRIBUNAL

THE PRESIDENT OF THE FIRST CHAMBER OF THE TRIBUNAL

makes the following

Order

1        By letters of 11 March 2010 and 18 March 2010, Mr Edwin Pritchard and Mr John Harling informed the Tribunal, in accordance with Article 74 of the Rules of Procedure, that they wished to discontinue their actions.

2        By letters of 16 March 2010 and 14 April 2010, the Commission indicated to the Tribunal that it had no observations to make concerning the discontinuance of proceedings.

3        It is thus necessary to remove the names of Mr Edwin Pritchard and Mr John Harling from the list of applicants in Case F‑103/09.

4        Under Article 89(5) of the Rules of Procedure, a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance.

5        Since the Commission in its observations has not applied for an order for costs against those applicants, it must be concluded that Mr Edwin Pritchard, Mr John Harling and the Commission will bear their own costs.

On those grounds,

THE PRESIDENT OF THE FIRST CHAMBER OF THE TRIBUNAL

hereby orders:

1.      The names of Mr Edwin Pritchard and Mr John Harling are removed from the list of applicants in Case F‑103/09.

2.      Mr Edwin Pritchard, Mr John Harling and the European Commission shall bear their own costs.
