THE PRESIDENT OF THE COURT,

after hearing the First Advocate General, M. Wathelet,

makes the following

Order

1        By document lodged via e-Curia on 16 February 2018, the Confédération européenne des associations d’horlogers-réparateurs (CEAHR) informed the Court, in accordance with Article 148 of the Rules of Procedure, that it wished to discontinue its appeal.

2        By document lodged via e-Curia on 21 February 2018, the Commission informed the Court that it had no remarks to make on that discontinuance, but requested nonetheless that the Confédération européenne des associations d’horlogers-réparateurs (CEAHR) be ordered to pay the costs.

3        By document lodged via e-Curia on 23 February 2018, LVMH Moët Hennessy-Louis Vuitton SA informed the Court that it had no remarks to make on that discontinuance, but requested nonetheless that the Confédération européenne des associations d’horlogers-réparateurs (CEAHR) be ordered to pay the costs.

4        By document lodged via e-Curia on 28 February 2018, Rolex, SA informed the Court that it had no remarks to make on that discontinuance, but requested nonetheless that the Confédération européenne des associations d’horlogers-réparateurs (CEAHR) be ordered to pay the costs.

5        By document lodged via e-Curia on 28 February 2018, The Swatch Group SA informed the Court that it had no remarks to make on that discontinuance, but requested nonetheless that the Confédération européenne des associations d’horlogers-réparateurs (CEAHR) be ordered to pay the costs.

6        Pursuant to the combined provisions of Articles 141(1) and 184(1) of the Rules of Procedure, a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.

7        The Confédération européenne des associations d’horlogers-réparateurs (CEAHR) must therefore be ordered to pay the costs.

On those grounds, the President of the Court hereby orders:

1.      Case C3/18 P is removed from the Register of the Court.

2.      The Confédération européenne des associations d’horlogers-réparateurs (CEAHR) shall pay the costs.
