Reference has been made to the Court of Justice of the European Communities by order of the Cour Administrative (Administrative Court) of 3 June 2003, received at the Court Registry on 13 June 2003, for a preliminary ruling in the appeal brought by the Minister for the Economy against Millennium Pharmaceuticals Inc., formerly Cor Therapeutics Inc. on the following question:
Does a marketing authorisation issued by the Swiss authorities constitute the first authorisation to place a product on the market in the Community within the meaning of Article 13 of Council Regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products
