The Tribunal:

annuls vacancy notice No 43/09 published with a view to filling the post of Director of the Directorate of General Affairs of the European Economic and Social Committee;

dismisses the action as to the remainder;

orders the European Economic and Social Committee to bear its own costs and to pay those incurred by Mr Bermejo Garde.
