Operative part of the judgment

The Tribunal:

Annuls the decision of 27 July 2008 to close the procedure opened under Article 73 of the Staff Regulations of Officials of the European Union following the accident to Mr Guittet on 8 December 2003;

Orders the European Commission to pay Mr Guittet the sum of EUR 2 500;

Dismisses the remainder of the action;

Orders the European Commission to bear its own costs and to pay the costs incurred by Mr Guittet.
