ORDER OF THE PRESIDENT OF THE FIRST CHAMBER OF THE EUROPEAN UNION CIVIL SERVICE TRIBUNAL

(Amicable settlement of the proceedings – Article 69(2) of the Rules of Procedure – Out-of-court settlement of the parties – Removal from the register)

In Case F‑80/12,

ACTION brought under Article 270 TFEU, applicable to the EAEC Treaty pursuant to Article 106a thereof,

Ronald de Bruin, member of the temporary staff, residing in Budapest (Hungary), represented by L. Levi and A. Blot, lawyers,

applicant,

Institut européen d’innovation et de technologie, represented by J.R. García‑Gallardo Gil-Fournier, lawyer,

THE PRESIDENT OF THE FIRST CHAMBER OF THE CIVIL SERVICE TRIBUNAL

makes the following

Order

1        By letter received at the Tribunal Registry on 11 October 2012, Mr R. de Bruin informed the Tribunal that he was discontinuing his action since the parties have arrived at an agreement which also covers costs.

2        By letter received by the Tribunal Registry on 15 October 2012, the defendant confirmed the existence of an agreement in the terms set out by the applicant and it informed the Tribunal that it was in agreement with the applicant’s discontinuance.

3        Consequently, in accordance with Article 69(2) of the Rules of Procedure, the agreement reached by the parties as to the resolution of the dispute should be noted and the case should be removed from the register of the Tribunal.

4        Under Article 69(3) of the Rules of Procedure, where there is an agreement between the parties as to costs, a decision as to costs is to be given in accordance with the agreement. The costs shall therefore be borne by the parties in accordance with the terms of their agreement.

On those grounds,

THE PRESIDENT OF THE FIRST CHAMBER OF THE CIVIL SERVICE TRIBUNAL

hereby orders:

1.      Case F‑80/12 shall be removed from the register of the Tribunal following the agreement concluded between Mr Ronald de Bruin and Institut européen d’innovation et de technologie.

2.      The parties shall bear the costs in accordance with the agreement concluded between them.
