Application: brought under Article 270 TFEU, applicable to the EAEC Treaty pursuant to Article 106a thereof, in which Mr Dubus seeks annulment of the Commission’s decision of 20 November 2009 not to include him in the list of officials promoted to grade AST 4 under the 2009 promotion exercise.

Held: Case F‑79/10 Dubus v Commission is removed from the register of the Tribunal. The parties are to bear the costs as agreed between them.
