ORDER OF THE PRESIDENT OF THE EIGHTH CHAMBER OF THE GENERAL COURT

APPLICATION pursuant to Article 263 TFEU seeking the annulment of Commission Decision (EU) 2017/1246 of 7 June 2017 endorsing the resolution scheme for Banco Popular Español S.A. (OJ 2017 L 178, p. 15).


1        By letter lodged at the Court Registry on 21 February 2018, the applicants informed the Court, in accordance with Article 125 of the Rules of Procedure of the General Court, that Ronit Capital LLP wished to discontinue proceedings.

2        By letter lodged at the Court Registry on 9 March 2018, the defendant informed the Court that it had no observations to make on that applicant’s withdrawal from the case. The defendant applied for the costs to be borne by the withdrawing party.

3        Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.

4        Accordingly, the applicant’s name, Ronit Capital, must be removed from the list of applicants and the withdrawing party must be ordered to pay the costs.

On those grounds,

THE PRESIDENT OF THE EIGHTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      The applicant’s name, Ronit Capital LLP, shall be removed from the list of applicants in Case T570/17.

2.      Ronit Capital shall pay its own costs as well as those of the defendant relating to it.
