APPLICATION for annulment of Commission decision Ares (2014) 1102834 of 8 April 2014, dismissing as inadmissible the application for internal review of Commission decision 2013/687/EU of 26 November 2013, on the notification by the Hellenic Republic, of a transitional national plan as referred to in Article 32 of Directive 2010/75/EU of the European Parliament and of the Council on industrial emissions (OJ 2013 L 317, p. 35).

1        By letter lodged at the Registry of the General Court on 24 February 2015, the applicant informed the Court in accordance with Article 99 of the Rules of Procedure that it wished to discontinue proceedings. It sought no order as to costs.

2        By letter lodged at the Registry of the Court on 27 February 2015, the defendant requested, pursuant to Article 87(5) of the Rules of Procedure, that the applicant be ordered to pay the costs.

3        The first subparagraph of Article 87(5) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings shall be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance. In the present case, the defendant requested that the applicant be ordered to pay the costs.

4        The case will therefore be removed from the register and the applicant ordered to pay the costs.

5        Accordingly, there is no need to rule upon the applications for leave to intervene lodged on 24 September 2014 by the Council of the European Union and on 7 October 2014 by the European Parliament in support of the form of order sought by the defendant.

On those grounds,

THE PRESIDENT OF THE SEVENTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-462/14 is removed from the register of the General Court.

2.      The applicant shall bear the costs.

3.      There is no need to rule upon the applications of the Council of the European Union and the European Parliament for leave to intervene.
