Reference for a preliminary ruling – Curtea de Apel Constanţa – Interpretation of Council Framework Decision 2002/584/JHA of 13 June 2002 on the European arrest warrant and the surrender procedures between Member States (OJ 2002 L 190, p. 1), and of Article 6 of the Charter of Fundamental Rights of the European Union – European arrest warrant issued for prosecution purposes – Possibility for the Member State responsible for executing the warrant to refuse the request for surrender of the person sought on grounds of failure to comply with the Convention for the Protection of Human Rights and Fundamental Freedoms and the Charter of Fundamental Rights of the European Union, and also because the Member State which issued the warrant has failed, in whole or in part, to transpose Framework Decision 2002/584/JHA into national law
