Annulment of Commission Decision C(2009) 4416 final of 10 June 2009, imposing on the applicant a EUR 20 000 fine for having implemented a concentration having Community dimension consisting in the acquisition of de facto sole control of the Compagnie Nationale du Rhône ('CNR'), before notifying the Commission and before it was declared compatible with the common market (COMP/M.4994 Electrabel v CNR – Compagnie Nationale du Rhône) and, in the alternative, the annulment of or the reduction of the amount of the fine imposed on the applicant.
