APPLICATION for taxation of costs to be paid by the applicants to the defendant following the judgment of the General Court of 10 October 2012 in Gem-Year and Jinn-Well Auto-Parts (Zhejiang) v Council (T‑172/09, EU:T:2012:532).

1        By letter lodged at the Court Registry on 22 January 2016, the defendant informed the Court, in accordance with Article 125 of the Rules of Procedure of the General Court, that due to an agreement reached with the applicants, it wished to discontinue proceedings and that the parties have agreed that each party should bear its own costs in relation with the application for taxation of costs.

2        By letter lodged at the Court Registry on 17 February 2016, the applicants confirmed that the parties have settled their dispute over the payments of costs and that the parties have agreed that each party should bear its own costs in relation to the application for taxation.

3        Article 136(3) of the Rules of Procedure provides that, where proceedings are discontinued and the parties have come to an agreement on costs, the order for costs is to be in accordance with that agreement.

4        The case shall therefore be removed from the register and the order for costs shall be as agreed between the parties.

On those grounds,

THE PRESIDENT OF THE FOURTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-172/09 DEP is removed from the register of the General Court.

2.      Each party shall bear its own costs.
