ORDER OF THE PRESIDENT OF THE SIXTH CHAMBER OF THE GENERAL COURT

16 July 2013 (1)

(Removal from the register)

In Case T-412/12,

bpost, established in Brussels (Belgium), represented by D. Geradin, lawyer,

applicant,

v

European Commission, represented by L. Armati, E. Gippini Fournier and D. Grespan, acting as Agents,

defendant,

ACTION for partial annulment of Commission Decision C(2012) 178 of 25 January 2012 on the measure SA.14588 (C 20/09) implemented by Belgium in favour of De Post-La Poste (now ‘bpost’) (OJ 2012 L 170, p. 1).

1        By letter lodged at the Registry of the General Court on 7 June 2013, the applicant informed the Court in accordance with Article 99 of the Rules of Procedure that it wished to discontinue proceedings. It sought no order on costs.

2        By letter lodged at the Registry of the Court on 24 June 2013, the defendant informed the Court that it had no observations to make on the discontinuance. It requested that the applicant be ordered to pay the costs of the proceedings.

3        The first subparagraph of Article 87(5) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings shall be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance.
