defendant,

APPLICATION for the annulment of the decision contained in the Commission’s letters to NDSHT of 24 March and 28 April 2006, relating to a complaint concerning allegedly unlawful State aid granted by the City of Stockholm to Stockholm Visitors Board AB (Case CP 178/04 – Alleged State aid to SVB AB) – Case C-322/09 P referred back by the Court of Justice after appeal,


1        By letter lodged at the Registry of the General Court on 13 July 2011, the applicant informed the Court, in accordance with Article 99 of the Rules of Procedure, that it wished to discontinue proceedings and that the question of costs had been the subject of an agreement between the parties. Accordingly, the applicant requested the Court to remove the case from the register and to order each party to bear its own costs.

2        By letter lodged at the Registry of the Court on 22 July 2011, the defendant requested that the General Court remove the case from the register and grant the form of order sought in the application for discontinuance.

3        The second subparagraph of Article 87(5) of the Rules of Procedure provides that, where proceedings are discontinued and the parties have come to an agreement on costs, the order for costs shall be in accordance with that agreement.

4        The case will therefore be removed from the register and each party shall be ordered to bear its own costs.

On those grounds,

THE PRESIDENT OF THE SEVENTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-152/06 RENV is removed from the register of the General Court.

2.      Each party shall bear its own costs.
