By its action under Article 263 TFEU, the applicant seeks the annulment and alteration of the decision of the First Board of Appeal of the European Union Intellectual Property Office (EUIPO) of 18 May 2023 (Case R 0164/2023-1).

Operative part of the order

1.    There is no longer any need to adjudicate on the action.

2.    Mar de Frades, SL shall bear its own costs and pay those incurred by Bodegas Aguiuncho, SL. The European Union Intellectual Property Office (EUIPO) shall bear its own costs.
