APPLICATION for legal aid pursuant to Article 94 of the Rules of Procedure,

THE PRESIDENT OF THE SECOND CHAMBER OF THE COURT OF FIRST INSTANCE OF THE EUROPEAN COMMUNITIES

makes the following

Order

1        By letter lodged at the Registry of the Court of First Instance on 12 March 2002, the applicants requested the Court to grant legal aid pursuant to Article 94 of the Rules of Procedure for the purpose of lodging an application to intervene in Case T-148/98 Evans and Others v Commission.

2        By letter lodged at the Court Registry on 13 September 2002, the Commission lodged its observations on the application for legal aid.

3        Under Article 94(2) of the Rules of Procedure, the President is to decide on the application for legal aid by way of an order without giving reasons, against which no appeal lies.

4        By order of 28 September 2005, the Court held that there is no further need to proceed to judgment on the main action in Case T-148/98.

5        In those circumstances, there is no further need to decide on the present application for legal aid.

On those grounds,

THE PRESIDENT OF THE SECOND CHAMBER OF THE COURT OF FIRST INSTANCE

hereby orders:

1.      There is no further need to decide on the present application for legal aid.
