The Tribunal:

Annuls the decision of the European Commission of 6 March 2012 refusing to employ Mr Marqués as a member of the contract staff in function group III;

Dismisses the remainder of the action;

Orders the European Commission to bear its own costs and to pay the costs incurred by Mr Marqués.
