ORDER OF THE PRESIDENTOF THE EIGHTH CHAMBER OF THE GENERAL COURT

European Commission, represented by B.-R. Killmann and S. Pardo Quintillán, acting as Agents,

defendant,

APPLICATION for annulment of the Commission decision establishing that irregularities had occurred in the implementation of the regional operational programme ‘Enhancing the Creative Knowledge Base of Cornwall’ for the period 2007 — 2013 and requiring a flat-rate correction of 25 %.


1        By letter lodged at the Court Registry on 16 August 2017, the applicant informed the Court in accordance with Article 125 of the Rules of Procedure of the General Court that it wished to discontinue proceedings and confirmed, pursuant to Article 136 of the Rules of Procedure, that the applicant will bear the costs.

2        By letter lodged at the Court Registry on 24 August 2017, the defendant informed the Court that it had no observations on the discontinuance and was in agreement with the applicant’s request to bear the costs, pursuant to Article 136(1) of the Rules of Procedure.

3        Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.

4        The case shall therefore be removed from the register and the applicant ordered to pay the costs.

On those grounds,

THE PRESIDENT OF THE EIGHTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-227/17 is removed from the register of the General Court.

2.      Falmouth University shall pay the costs.
