Re:

By its action under Article 263 TFEU, the Portuguese Republic seeks the partial annulment of Commission Implementing Decision (EU) 2022/908 of 8 June 2022 excluding from European Union financing certain expenditure incurred by the Member States under the European Agricultural Guarantee Fund (EAGF) and under the European Agricultural Fund for Rural Development (EAFRD) (OJ L 157 2022, p. 15), in so far as it relates to expenditure that the Portuguese Republic incurred in the amount of EUR 117 066 097.40 in respect of claim years 2016 to 2019.

Operative part of the judgment

The Court:

Dismisses the action;

Orders the Portuguese Republic to pay the costs.
