defendant,

ACTION for annulment of the Commission Implementing Regulation No 578/2012 of 29 June 2012 concerning the non-approval of the active substance diphenylamine, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market (OJ 2012 L 171, p. 2).


1        By letter lodged at the Registry of the General Court on 12 December 2013, the applicants informed the Court, in accordance with Article 99 of the Rules of Procedure, that they wished to discontinue proceedings and requested, pursuant to Article 87 of the Rules of Procedure, that each party bear its own costs.

2        By letter lodged at the Registry of the Court on 18 December 2013, the defendant informed the Court that it had no objections to discontinue proceedings and accepted that each party should bear its own costs, given the fact that it had not incurred reimbursable expenses at this stage of the proceedings.

3        The second subparagraph of Article 87(5) of the Rules of Procedure provides that, where proceedings are discontinued and the parties have come to an agreement on costs, the order for costs shall be in accordance with that agreement.

4        The case will therefore be removed from the register and each party shall bear its own costs.

On those grounds,

THE PRESIDENT OF THE THIRD CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-415/12 is removed from the register of the General Court.

2.      Each party shall bear its own costs.
