Action brought against the decision of the Fourth Board of Appeal of OHIM of 22 October 2010 (Case R 463/2009-4) relating to cancellation proceedings between TeliaSonera Denmark A/S and Deutsche Telekom AG.

1        By letter lodged at the Registry of the General Court on 31 August 2012, the applicant informed the General Court in accordance with Article 99 of the Rules of Procedure that it wished to discontinue proceedings. It sought no order as to costs.

2        By letter lodged at the Registry of the General Court on 10 September 2012, the defendant informed the General Court that it had no objection to the discontinuance of the proceedings. It sought no order as to costs.

3        By letter lodged at the Registry of the General Court on 12 September 2012, the other party to the proceedings before the Board of Appeal informed the General Court that it consents to the discontinuance of the proceedings in accordance with the request of discontinuance lodged by the applicant on 31 August 2012 and which was countersigned by the other party to the proceedings before the Board of Appeal.

4        The third subparagraph of Article 87(5) of the Rules of Procedure provides that, where proceedings are discontinued and costs are not applied for, the parties are to bear their own costs.

5        The case will therefore be removed from the register and, in the absence of any claim in that regard, the parties ordered to bear their own costs.

On those grounds,

THE PRESIDENT OF THE SECOND CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-583/10 is removed from the register of the General Court.

2.      Each party shall bear its own costs.
