Påstande i henhold til artikel 272 TEUF omor det første, at Kommissionens krav om tilbagebetaling af den støtte, der er udbetalt til sagsøgeren i medfør af kontrakterne 027020 »Access to e-Government Services Employing Semantic Technologies«, 035242 »A virtual platform to enhance and organize the coordination among centres for accessibility ressources and support«, 511298 »Ambient Intelligence System of Agents for Knowledge-based and Integrated Services for Mobility Impaired Users«, 034778 »European Unified Approach for Accessible Lifelong Learning«, 045056 »Emergency Monitoring and Prevention«, 045563 »A wearable system supporting services to enable elderly people to live well, independently and at ease«, 029255 »NavigAbile : e-inclusion for communication disabilities«, 517506 »European Recommanded Materials for Distance Learning Courses for Educators« og 224988 »T-Seniority: Expanding the benefits of information society to older people through digital TV channels«, indgået mellem EF-Kommissionen og sagsøgeren, og for det andet at Kommissionen tilpligtes at udbetale restbeløbet i henhold til kontrakterne 511298 »Ambient Intelligence System of Agents for Knowledge-based and Integrated Services for Mobility Impaired Users« og 034778 »European Unified Approach for Accessible Lifelong Learning«, erklæres ubegrundet, og for det andet at Kommissionen tilpligtes at betale støtten i henhold til kontrakt 511298 »Ambient Intelligence System of Agents for Knowledge-based and Integrated Services for Mobility Impaired Users« og 034778 »European Unified Approach for Accessible Lifelong Learning«. Der er endvidere fremsat et modkrav med påstand om, at sagsøgeren tilpligtes at tilbagebetale støtte, som uberettiget er udbetalt i forbindelse med samtlige disse kontrakter og den faste godtgørelse.
Konklusion
1) Europa-Kommissionen frifindes i det af Koinonia Tis Pliroforias Anoichti Stis Eidikes Anagkes – Isotis anlagte søgsmål.
2) Koinonia Tis Pliroforias Anoichti Stis Eidikes Anagkes – Isotis betaler et beløb på 999 213,45 EUR, med tillæg af renter efter Den Europæiske Centralbanks rentesats fra den 15. juni 2011, forhøjet med 3,5 procentpoint, der svarer til tilbagebetaling af de finansielle bidrag, som selskabet modtog i henhold til kontrakterne 027020 »Access to e-Government Services Employing Semantic Technologies«, 035242 »A virtual platform to enhance and organize the coordination among centres for accessibility ressources and support«, 511298 »Ambient Intelligence System of Agents for Knowledge-based and Integrated Services for Mobility Impaired Users«, 034778 »European Unified Approach for Accessible Lifelong Learning«, 045056 »Emergency Monitoring and Prevention«, 045563 »A wearable system supporting services to enable elderly people to live well, independently and at ease«, 029255 »NavigAbile: e-inclusion for communication disabilities«, 517506 »European Recommanded Materials for Distance Learning Courses for Educators« og 224988 »T-Seniority: Expanding the benefits of information society to older people through digital TV channels«.
3) Koinonia Tis Pliroforias Anoichti Stis Eidikes Anagkes – Isotis betaler et beløb på 70 471,47 EUR, med tillæg af renter efter Den Europæiske Centralbanks rentesats fra den 5. august 2011, forhøjet med 3,5 procentpoint, der svarer til den faste godtgørelse i medfør kontrakterne 027020 »Access to e-Government Services Employing Semantic Technologies«, 035242 »A virtual platform to enhance and organize the coordination among centres for accessibility ressources and support«, 511298 »Ambient Intelligence System of Agents for Knowledge-based and Integrated Services for Mobility Impaired Users«, 034778 »European Unified Approach for Accessible Lifelong Learning«, 045056 »Emergency Monitoring and Prevention«, 045563 »A wearable system supporting services to enable elderly people to live well, independently and at ease«.
4) Koinonia Tis Pliroforias Anoichti Stis Eidikes Anagkes – Isotis bærer sine egne omkostninger og betaler Europa-Kommissionens omkostninger.
