The applicant claims that the Court should:

Declare that, by failing to review, and if necessary update, and by failing to make available to the Commission the flood risk management plans within the prescribed periods, the Slovak Republic has failed to fulfil its obligations under Article 14(3) and Article 15(1) of Directive 2007/60/EC 1 of the European Parliament and of the Council of 23 October 2007 on the assessment and management of flood risks;

Order the Slovak Republic to pay the costs.

Pleas in law and main arguments

Pursuant to Article 14(3) of Directive 2007/60/EC, EU Member States were under an obligation to review, and if necessary update, flood risk management plans by 22 December 2021. Pursuant to Article 15(1) of Directive 2007/60/EC, EU Member States were to make available to the Commission their review and, where applicable, their updates of the flood risk management plans by 22 March 2022.

The Slovak Republic has failed to fulfil its obligations under Article 14(3) and Article 15(1) of Directive 2007/60/EC by those time limits.
