having regard to the judgment of 18 October 2023, TestBioTech v Commission (T‑606/21, not published, EU:T:2023:649),
makes the following
Order
1 The Court delivered the judgment of 18 October 2023, TestBioTech v Commission (T‑606/21, not published, EU:T:2023:649).
2 In accordance with Article 164(1) of the Rules of Procedure of the General Court, it is necessary to rectify clerical mistakes found in paragraphs 25 to 27, 29, 39, 62 and 63 of that judgment.
On those grounds,
THE GENERAL COURT (Second Chamber)
hereby orders:
1. In paragraphs 25 to 27, 29, 39, 62 and 63 of the judgment, the reference to “Article 4(1)(a) and Article 16(1)(a) of Regulation No 1367/2006” must be replaced by a reference to “Article 4(1)(a) and Article 16(1)(a) of Regulation No 1829/2003”.
2. In paragraphs 25 and 27 of the judgment, the reference to “Article 4(2), (3) and (5) and Article 16(2), (3) and (5) of Regulation No 1367/2006” must be replaced by a reference to “Article 4(2), (3) and (5) and Article 16(2), (3) and (5) of Regulation No 1829/2003”.
3. In paragraphs 26, 29, 39, 62 and 63 of the judgment, the reference to “Article 5(a) of Implementing Regulation No 503/2013” must be replaced by a reference to “Article 5 of Implementing Regulation No 503/2013”.
