ORDER OF THE PRESIDENT
OF THE SIXTH CHAMBER OF THE GENERAL COURT

In Case T-23/23,

Noyan Abr Arvan Private JS, established in Tehran, (Iran), represented by K. Adamantopoulos and P. Billiet, lawyers,

1        By its action, first, under Article 263 TFEU, the applicant seeks the annulment of Council Implementing Regulation (EU) 2022/2231 of 14 November 2022 implementing Regulation (EU) No 359/2011 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Iran (OJ 2022 L 2931, p. 16), in so far as it includes the applicant’s name in Annex I to Regulation No 359/2011, and, second, under Article 277 TFEU, the applicant seeks a declaration by the General Court that Regulation No 359/2011 is inapplicable in so far as it concerns the inclusion of the applicant’s name in Annex I thereto.

2        By letter lodged at the Court Registry on 2 June 2024, the applicant informed the Court, in accordance with Article 125 of the Rules of Procedure of the General Court, that it wished to discontinue proceedings. It sought no order as to costs.

3        By letter lodged at the Court Registry on 17 June 2024, the defendant informed the Court that it had no observations on the application for discontinuance. The defendant requested, pursuant to Article 136(1) of the Rules of Procedure, that the applicant be ordered to bear the costs.

4        Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.

5        The case shall therefore be removed from the Register and the applicant ordered to bear its own costs and to pay those incurred by the defendant.

On those grounds,

THE PRESIDENT OF THE SIXTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-23/23 is removed from the Register of the General Court.

2.      Noyan Abr Arvan Private JS shall bear its own costs and pay those incurred by the Council of the European Union.
