Action brought against the decision of the Fourth Board of Appeal of OHIM of 23 October 2012 (R 1950/2011-4) relating to opposition proceedings between MasterCard International, Inc. and Sheetal Nehra,
1 By letter lodged at the Registry of the General Court on 16 May 2013, the applicant informed the Court in accordance with Article 99 of the Rules of Procedure that it wished to discontinue proceedings and that the parties have agreed that each will bear its own costs in these proceedings.
2 By letter lodged at the Registry of the General Court on 29 May 2013, the defendant informed the Court that it had no objection to the discontinuance of the proceedings and requested that each party be ordered to bear its own costs.
3 According to the second subparagraph of Article 87(5) of the Rules of Procedure, where the parties have come to an agreement on costs, the decision as to costs shall be in accordance with that agreement.
4 The case will therefore be removed from the register and, in accordance with their agreement, the parties will be ordered to bear their own costs.
On those grounds,

THE GENERAL COURT
hereby orders:
1. Case T-13/13 is removed from the register of the General Court.
2. Each party shall bear its own costs.
