appellant,

the other parties to the proceedings being:

Council of the European Union, represented by M. Bishop and E. Finnegan, acting as Agents,

defendant at first instance,

Commission of the European Communities, represented by C. Brown and P.J. Kuijper, acting as Agents, with an address for service in Luxembourg,

defendant at first instance,

United Kingdom of Great Britain and Northern Ireland, represented by R. Caudwell, acting as Agent, A. Dashwood, Barrister, and C. Greenwood QC,

intervener at first instance,

THE PRESIDENT OF THE COURT,

after hearing Advocate General Poiares Maduro,

makes the following

Order

1       By application lodged at the Court Registry on 9 March 2006, the Kingdom of Spain, having an address for service in Luxembourg, sought leave to intervene in Case C‑402/05 P in support of the Council of the European Union.

2       By application lodged at the Court Registry on 23 March 2006, the Kingdom of the Netherlands, represented by H. Sevenster, acting as Agent, sought leave to intervene in Case C‑402/05 P in support of the Council of the European Union.

3       By application lodged at the Court Registry on 24 March 2006, the French Republic, represented by E. Belliard, acting as Agent, sought leave to intervene in Case C‑402/05 P in support of the Council of the European Union and the Commission of the European Communities.

4       The applications to intervene were made in accordance with Articles 93(1) and 123 of the Rules of Procedure and are submitted pursuant to the first paragraph of Article 40 of the Statute of the Court.

On those grounds,

THE PRESIDENT OF THE COURT

hereby orders:

1.      The Kingdom of Spain is granted leave to intervene in Case C‑402/05 P in support of the form of order sought by the Council of the European Union.

2.      The Kingdom of the Netherlands is granted leave to intervene in Case C‑402/05 P in support of the form of order sought by the Council of the European Union.

3.      The French Republic is granted leave to intervene in Case C‑402/05 P in support of the form of order sought by the Council of the European Union and the Commission of the European Communities.

4.      A period shall be prescribed within which the interveners must state in writing the pleas relied on in support of the forms of order which they seek.

5.      The Registrar shall serve on the interveners a copy of every document served on the parties.

6.      The costs are reserved.
