Touchnet Information Systems, Inc., established in Lenexa (United States),

Action brought against decision R 493/2007-2 of the Second Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) of 28 May 2008, relating to opposition proceedings between iTouch International plc and Touchnet Information Systems, Inc


1        The applicant lodged an application at the Registry of the Court of First Instance on 20 August 2008.

2        By letter lodged at the Registry of the Court of First Instance on 2 October 2008, the applicant informed the Court, in accordance with Article 99 of the Rules of Procedure of the Court of First Instance, that it wished to discontinue proceedings.

3        The case will therefore be removed from the register.

4        With regard to the costs, since the application was not served on the parties, the applicant shall bear its own costs.

On those grounds,

THE PRESIDENT OF THE SIXTH CHAMBER OF THE COURT OF FIRST INSTANCE

hereby orders:

1.      Case T-347/08 is removed from the register of the Court of First Instance.

2.      The applicant shall bear its own costs.
