Must Council Regulation (EC) No 1083/2006 of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999, 1 in particular Article 2(5), Articles 3 and 4, Article 57(1), and Articles 70 and 80 thereof, and, currently, Regulation (EU) No 1303/2013 of the European Parliament and of the Council of 17 December 2013 laying down common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Agricultural Fund for Rural Development and the European Maritime and Fisheries Fund and laying down general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Maritime and Fisheries Fund and repealing Council Regulation (EC) No 1083/2006, 2 in particular Article 2(15), Article 37(1), Article 66, Article 67(1), Article 74(1) and Article 89(1) thereof, be interpreted as precluding national legislation which prevents an entity that has received resources from the budget of the European Union from effectively seeking in court proceedings that those resources be excluded from the insolvency estate where they have been paid into a bank account held at a bank which was subsequently declared insolvent, or national legislation which does not exclude those resources from the insolvency estate of the insolvent bank?
