ORDER OF THE PRESIDENT OF THE APPEAL CHAMBER OF THE GENERAL COURT

APPLICATION for legal aid pursuant to Article 95(1) of the Rules of Procedure of the General Court,

THE PRESIDENT OF THE APPEAL CHAMBER OF THE GENERAL COURT,

makes the following

Order

1        By document lodged at the Registry of the Court on 17 February 2010, the applicant, Mr Svetoslav Apostolov, lodged an appeal seeking to have set aside the order of the Civil Service Tribunal of the European Union (First Chamber) of 15 December 2009 in Case F‑8/09 Apostolov v Commission [2009] ECR‑SC I‑A‑1‑0000 and ECR II‑A‑1‑0000. The appeal has been registered as Case T‑73/10 P.

2        By form lodged at the Registry of the Court on 26 March 2010, the applicant made an application for the grant of legal aid for the purposes of his appeal in Case T‑73/10 P.

3        In its observations submitted to the Registry of the Court on 15 April 2010, the Commission indicates that it defers to the wisdom of the Court. However, it considers the appeal to be inadmissible in part and, in any event, manifestly unfounded and considers that, in the light of the particular circumstances of the case, it is unlikely that the applicant would not be able to pay the costs involved in legal assistance and representation by a lawyer.

4        Pursuant to Article 94(3) of the Rules of Procedure of the Court, legal aid is to be refused if the action in respect of which the application is made appears to be manifestly inadmissible or manifestly unfounded.

5        By order of even date, the Court has dismissed the appeal brought by Mr Apostolov as being, in part, manifestly inadmissible and, in part, manifestly unfounded.

6        It follows from the foregoing that the application for legal aid must be refused.

hereby orders:

The application for legal aid in Case T‑73/10 P‑AJ is refused.
