Núñez-Müllers) - application for annulment of the decision of the Commission contained in order for recovery No 3240305411 of 13 September 2001 - the Court of First Instance (Fifth Chamber), composed of J.D. Cooke, President, R. García-Valdecasas and P. Lindh, Judges; H. Jung, Registrar, made an order on 7 June 2002, the operative part of which is as follows:
1.There is no need to adjudicate on the present action.
2.The Commission shall bear the costs.
