APPLICATION for annulment of Commission decision Ares (2014) 2589479 of 5 August 2014 concerning the applicants’ request under Article 6(2) of Regulation (EC) No 396/2005 of the European Parliament and of the Council of 23 February 2005 on maximum residue levels of pesticides in or on food and feed of plant and animal origin and amending Council Directive 91/414/EEC (OJ 2005 L 70, p. 1).
1 By letter lodged at the Registry of the General Court on 16 April 2015, the applicants informed the Court, in accordance with Article 99 of the Rules of Procedure of the General Court, that they wished to discontinue proceedings. They sought no order as to costs.
2 By letter lodged at the Registry of the Court on 4 May 2015, the defendant agreed that the case be removed from the register pursuant to Article 99 of the Rules of Procedure and requested that the applicants be ordered to pay the costs.
3 The first subparagraph of Article 87(5) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings shall be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance. In the present case, the defendant requested that the applicants be ordered to pay the costs.
4 The case will therefore be removed from the register and the applicants ordered to pay the costs.
On those grounds,
THE PRESIDENT OF THE SEVENTH CHAMBER OF THE GENERAL COURT
hereby orders:
1. Case T-729/14 is removed from the register of the General Court.
2. The applicants shall bear the costs.
