ORDER OF THE PRESIDENT
OF THE FIRST CHAMBER (EXTENDED COMPOSITION) OF THE GENERAL COURT

In Case T-150/14,

Constantinos Pavlides, residing in Nicosia (Cyprus), represented by C. Pascalides, Solicitor, and A. Pascalides, lawyer,

applicant,

v

European Commission, represented by B. Smulders, J.‑P. Keppenne, M. Konstantinidis and T. Maxian Rusche, acting as Agents,

and

European Central Bank (ECB), represented by M. Szablewska and O. Heinz, acting as Agents, and H.‑G. Kamann, lawyer,

defendants,

ACTION under Article 268 TFUE seeking compensation for damage allegedly suffered by the applicant as a result of acts taken in the context of the “conditionality attached to financial assistance provided to Cyprus on 26 April 2013 pursuant to Article 13 of the European Stability Mechanism Treaty of 2012”.


 

1        By letter lodged at the Court Registry on 2 March 2021, the applicant informed the Court, in accordance with Article 125 of the Rules of Procedure of the General Court, that he wished to discontinue proceedings. He sought no order as to costs.

2        By letter lodged at the Court Registry on 16 March 2021, the European Central Bank (ECB) informed the Court that it welcomed the withdrawal and the removal from the register and requested, in accordance with Article 136 of the Rules of Procedure, that the applicant be ordered to pay the costs of the proceedings.

3        By letter lodged at the Court Registry on 16 March 2021, the European Commission informed the Court that it took note of the withdrawal of the case by the applicant and that the question of costs had been the subject of an agreement between the Commission and the applicant whereby they will each bear their own costs.

4        Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.

5        Article 136(3) of the Rules of Procedure provides that where the parties have come to an agreement on costs, the decision as to costs shall be in accordance with that agreement.

6        Accordingly, the case shall be removed from the register and the applicant ordered to bear his own costs and those incurred by the ECB.

7        The Commission is to bear its own costs.

On those grounds,

THE PRESIDENT OF THE FIRST CHAMBER (EXTENDED COMPOSITION) OF THE GENERAL COURT

hereby orders:

1.      Case T-150/14 is removed from the register of the General Court.

2.      Constantinos Pavlides shall bear his own costs and those incurred by the European Central Bank.

3.      The European Commission shall bear its own costs.
