Operative part of the judgment

The Court:

Dismisses the action;

Orders Dimosia Epicheirisi Ilektrismou AE (DEI), in addition to bearing its own costs, to pay those incurred by the European Commission;

Declares that the Hellenic Republic is to bear its own costs.
