Application: brought under Articles 236 EC and 152 EA, in which Mr Nikolchov, a member of the contract staff of the Commission from 1 October 2008 to 15 January 2009, then an official at the same institution from 16 January 2009, essentially seeks annulment of the Commission’s decision of 29 July 2009 refusing, upon his second entry into service, to grant him the daily allowance provided for in Article 10(2) of Annex VII to the Staff Regulations of Officials of the European Union.

Held: Case F‑94/09 Nikolchov v Commission is removed from the register of the Tribunal. Notice is given that the applicant has withdrawn his action, including in relation to costs. The Commission is to pay the applicant a fixed sum of EUR 2 500 towards his costs. The applicant is to bear the remainder of his costs. The Commission is to bear its own costs.
