The applicants claim that the Court should:

declare the present action admissible and well founded;

annul the defendant’s decision of 4 July 2023 concerning the applicants’ pension rights;

in so far as is necessary, annul the defendant’s decision of 5 February 2024 rejecting the applicants’ individual complaints;

order the defendant to pay all the costs.

Pleas in law and main arguments

In support of the action, the applicants rely on one principal plea in law and a plea in the alternative.

Principally, the applicants allege infringement of Articles 21, 22 and 28 of Annex XIII to the Staff Regulations of Officials of the European Union (‘the Staff Regulations’).

In the alternative, the applicants raise a plea of illegality on the ground that Article 28 of Annex XIII to the Staff Regulations infringes the principle of equal treatment.
