ORDER OF THE PRESIDENT OF THE EIGHTH CHAMBER OF THE GENERAL COURT

APPLICATION for annulment of Council Decision 2013/144/CFSP of 21 March 2013 amending Decision 2011/172/CFSP concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Egypt (OJ L 82, p.54), insofar as it concerns the applicants.


1        By letter lodged at the Registry of the General Court on 23 June 2014, the applicants informed the Court in accordance with Article 99 of the Rules of Procedure that they wished to discontinue proceedings. They sought no order as to costs.

2        By letter lodged at the Registry of the Court on 27 June 2014, the defendant informed the Court that it has no objections and the case should be removed from the register. It requested that the applicants should be ordered to bear the costs, including those of the defendant.

3        The first subparagraph of Article 87(5) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings shall be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance. In the present case, the applicants sought no order as to costs and the defendant requested that the applicants should be ordered to bear the costs.

4        The case will therefore be removed from the register and the applicants ordered to pay the costs, including those of the defendant.

5        Accordingly, there is no need to rule upon the application for leave to intervene lodged on 4 October 2013 by the European Data Protection Supervisor in support of the form of order sought by the applicants.

On those grounds,

THE PRESIDENT OF THE EIGHTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-319/13 is removed from the register of the General Court.

2.      The applicants shall bear their own costs and those of the defendant.

3.      There is no need to rule upon the application of the European Data Protection Supervisor for leave to intervene.
