APPLICATION for legal aid pursuant to Article 95 of the Rules of Procedure of the Court of First Instance,

THE PRESIDENT

makes the following

Order

1        By application lodged at the Registry of the Court of First Instance on 3 January 2008, Mr Sakr Ghassan applied for legal aid in order to bring an action against the Ministry of Interior of the Republic of Hungary and the Hungarian Center Court Economic Section.

2        The applicant claims to have lost his firm and property due to an alleged illegal liquidation procedure and robberies allegedly covered up by the Hungarian authorities.

3        Under Article 94(3) of the Rules of Procedure, legal aid is to be refused if the action in respect of which the application is made appears to be manifestly inadmissible or manifestly unfounded.

4        Under Article 96(1) of the Rules of Procedure, the Court of First Instance invites, before giving its decision on an application for legal aid, the other party to submit its written observations unless it is already apparent from the information produced that the conditions laid down in Article 94(3) have been satisfied.

5        In the present case, the applicant requests legal aid in order to bring an action against a Member State and a national court. However, the Court of First Instance does not have jurisdiction to rule on actions brought by individuals against Member States or national authorities or institutions. Nor does the Court have jurisdiction to review the decisions of national courts or tribunals.

6        As the action in respect of which the application is made must be dismissed as manifestly inadmissible on the ground of manifest lack of jurisdiction, it follows that the application for legal aid must be rejected without it being necessary to hear the other parties concerned.

On those grounds,

THE PRESIDENT OF THE COURT OF FIRST INSTANCE

hereby orders:

The application for legal aid in Case T-47/08 AJ is rejected.
