Application:      under Article 270 TFEU, applicable to the EAEC Treaty by virtue of Article 106a thereof, in which Mr Navarro seeks annulment of the European Commission’s decision of 4 October 2012 refusing to employ him as a member of the contract staff in function group II, together with compensation for loss suffered.

Held:      The action is dismissed. Each party is to bear its own costs.
