makes the following

Order

1       By letter lodged at the Court Registry on 20 October 2005, Mr Ranbir Kumar applied for legal aid pursuant to Article 94 of the Rules of Procedure of the Court of First Instance.

2       The applicant for legal aid wishes, on the one hand, to bring an action against the Commission of the European Communities for failure to act in that the Commission failed to take measures or bring proceedings against the United Kingdom for its breaches of national law, more specifically the Data Protection Act, and of Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (OJ L 281, p. 31).

3       On the other hand, he wishes to bring an action for annulment of the decisions contained in the Commission's letters in reply to the applicant's complaint, which allegedly failed to take into account legally relevant matters and concluded that there was no infringement of Community Law by the United Kingdom and informed the applicant that it would close the case.

4       Under Article 94(2) of the Rules of Procedure, the decision on legal aid shall be taken by way of an order of the President without giving reasons, and no appeal shall lie therefrom.

5       In accordance with the third subparagraph of Article 94(2) of said Rules, the President shall consider whether there is manifestly no cause of action. The President has established that the action of the applicant for legal aid is manifestly unfounded.

6       Having regard to the above considerations, it follows that the application for legal aid must be rejected without it being necessary to hear the other parties concerned.

On those grounds,

THE PRESIDENT OF THE COURT OF FIRST INSTANCE

hereby orders:

1.      The application for legal aid in Case T- 390/05 AJ is rejected.
