ORDER OF THE PRESIDENT OF THE SEVENTH CHAMBER OF THE GENERAL COURT

APPLICATION for annulment of Commission decision Ares (2013) 3210021 of 9 October 2013, dismissing as inadmissible the application for internal review of Commission Implementing Regulation (EU) No 485/2013 of 24 May 2013 amending Implementing Regulation (EU) No 540/2011, as regards the conditions of approval of the active substances clothianidin, thiamethoxam and imidacloprid, and prohibiting the use and sale of seeds treated with plant protection products containing those active substances (OJ 2013 L 139, p. 12).


1        By letter lodged at the Registry of the General Court on 24 February 2015, the applicants informed the Court in accordance with Article 99 of the Rules of Procedure that they wished to discontinue proceedings. They sought no order as to costs.

2        By letter lodged at the Registry of the Court on 27 February 2015, the defendant requested, pursuant to Article 87(5) of the Rules of Procedure, that the applicants be ordered to pay the costs.

3        The first subparagraph of Article 87(5) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings shall be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance. In the present case, the defendant requested that the applicants be ordered to pay the costs.

4        The case will therefore be removed from the register and the applicants ordered to pay the costs.

5        Accordingly, there is no need to rule upon the applications for leave to intervene lodged on 9 April 2015 by the Council of the European Union and on 11 April 2015 by the European Parliament in support of the form of order sought by the defendant.

On those grounds,

THE PRESIDENT OF THE SEVENTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-671/13 is removed from the register of the General Court.

2.      The applicants shall bear the costs.

3.      There is no need to rule upon the applications of the Council of the European Union and the European Parliament for leave to intervene.
