The appellant claims that the Court should:

set aside the judgment under appeal and declare the appellant’s requests admissible and well-founded;

annul EUIPO’s decision of 8 September 2020 rejecting appellant’s application for a transfer to EUIPO and annul the decision of the Chairperson of the Management Board of EUIPO of 22 March 2021, rejecting the complaint filed under Article 90(2) of the Staff Regulations against the decision of 8 September 2020 or, if this is not possible, refer the case before the General Court for judgement, and;

order the defendant to bear the costs.

Pleas in law and main arguments

The appellant submits that by rejecting the three pleas put forward in first instance, the General Court made some errors in law, misconstrued the appellant’s pleas, making errors of reasoning and breaching the rights of defense and the right to an effective remedy of the appellant and has distorted evidence or has made some findings not supported by the submissions of the parties.
