ORDER OF THE PRESIDENT OF THE NINTH CHAMBER OF THE GENERAL COURT

1        By her application based on Article 270 TFEU, the applicant, BP, seeks, first, the annulment of the defendant’s decision of 15 January 2024 not to renew her contract and, second, compensation for the material and moral damage she alleges she suffered as a result of that decision.

2        By letter lodged at the Court Registry on 22 February 2024, the applicant informed the Court, in accordance with Article 124 of the Rules of Procedure of the General Court, that she wished to discontinue proceedings. By the same letter, she informed the Court that the parties had reached an amicable settlement of their dispute, which included an agreement as to costs.

3        By letter lodged at the Court Registry on 27 February 2024, the defendant, in its observations on the withdrawal of the case, confirmed to the Court that the parties’ dispute had been resolved amicably, out of court, and that their agreement extended to the matter of costs.

4        Article 136(3) of the Rules of Procedure provides that, where proceedings are discontinued and the parties have come to an agreement on costs, the order for costs is to be in accordance with that agreement.

5        The case shall therefore be removed from the Register and the order for costs shall be as agreed between the parties.

On those grounds,

THE PRESIDENT OF THE NINTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-42/24 is removed from the Register of the General Court.

2.      The costs are supported as agreed between the parties in the outofcourt amicable settlement signed on 21 February 2024.
