1 By application pursuant to Article 170(1) of the Rules of Procedure of the General Court, the intervener requested the Court to fix the amount of recoverable costs to be reimbursed by the applicant following the judgment of 20 October 2021, Yadex International v EUIPO – Sütas Süt Ürünleri (PINAR Tam kivaminda Süzme Peynir Yumusacik ve Leziz) (T‑560/20, non published, EU:T:2021:714).
2 By letter lodged at the Court Registry on 31 August 2022, the intervener informed the Court, pursuant to Article 125 of the Rules of Procedure of the General Court, that it wished to discontinue the proceedings.
3 The case must therefore be removed from the register.
4 As the proceedings were discontinued prior to service of the application for taxation of costs on the applicant and before the latter could have incurred costs, it is sufficient to decide that the intervener must bear its own costs.
On those grounds,
THE PRESIDENT OF THE SIXTH CHAMBER OF THE GENERAL COURT
hereby orders:
1. Case T-560/20 DEP is removed from the register of the General Court.
2. Sütas Süt Ürünleri AS shall bear its own costs.
