In Case T-233/01: Daniel Caillebout, an official of the Commission of the European Communities, residing in Mondorf-les-Bains (Luxembourg), represented by J.-N. Louis and V. Peere, lawyers, with an address for service in Luxembourg, against Commission of the European Communities (Agent: C. Berardis-Kayser) - application for annulment of the decision of the Commission of 14 August 2000 not to promote the applicant to Grade B 2 in the 2000 promotions procedure - the Court of First Instance (Third Chamber), composed of M. Jaeger, President, K. Lenaerts and J. Azizi, Judges; J. Plingers, Administrator, for the Registrar, gave a judgment on 9 July 2002, in which it:

1.annuls the decision of the Commission of 14 August 2000 not to promote the applicant to Grade B 2 in the 2000 promotions procedure.

    2.orders the Commission to pay the costs.
