Action brought on 1 March 2004 by Åsa Sundholm against Commission of the European Communities

An action against the Commission of the European Communities was brought before the Court of First Instance of the European Communities on 1 March 2004 by Åsa Sundholm, residing in Brussels, represented by Sébastien Orlandi, Albert Coolen, Jean-Noël Louis and Etienne Marchal, lawyers.

The applicant claims that the Court should:

Annul the decision of 10 April 2003 adopting the applicant's career development report for the period from 1 July 2001 to 31 December 2002;

Order the defendant to pay the costs.

Pleas in law and main arguments

In support of her application the applicant submits that the disputed report makes reference to her justified absences and to her state of health in breach of Article 7(2) of the general provisions for implementing Article 43 of the Staff Regulations. She also pleads that there was a manifest error of assessment in that there were allegedly inconsistencies between the comments and the marks awarded to her in that report. Finally, the applicant submits that the report does not state adequate reasons, particularly as it departs from the recommendations of the Joint Evaluation Committee and must, under Article 8(7) of the general provisions for implementing Article 43 of the Staff Regulations, give reasons for doing so.
